Terms and Conditions of purchase and use

These Terms and Conditions of Sale will govern the purchase and sale of products that Antonio J. 1. Acceptance of the Terms and Conditions of Sale and Access to the Website

By using the services of the Website, the User accepts these Terms and Conditions of Sale, which define the rights and obligations of Charcutería Seco and the Users within the framework of the Website. These are the only Terms and Conditions of Sale applicable to the use of the Website (without prejudice to the fact that certain services may have specific conditions) and to the ordering of products through the Website, replacing any other conditions, except by prior written agreement between Charcutería Seco and the User.

User registration is not required to access the Website. However, to contract any of the services offered by Charcutería Seco, User registration and acceptance of these conditions will be required before completing the corresponding payment.

2. Purpose

This website has been designed to showcase the services offered by Charcutería Seco, to provide information about the products, prices, and offers, as well as to sell its products.

3. Shipping Conditions

Shipping costs will be borne by the customer and are not included in the product price. Shipping costs may vary depending on the location and the weight of the product within the mainland and the Balearic Islands. No deliveries will be made on holidays.

4. Returns and Exchange Policy, Right of Withdrawal, and Exceptions

The maximum period for returns or claims is 7 natural days from the receipt of the order. (In the case of choosing the "In-store Pickup" option, the period will begin once it is notified that the order is ready for pickup).

Charcutería Seco is not responsible if the User sends the order to an address that does not correspond to the one indicated above.

 - Exchanges:

Product exchanges are not allowed.

 - Returns:

In the event that the User is not satisfied with the products received in their order, the User, in accordance with the General Law for the Defense of Consumers and Users, will have a period of seven (7) natural days to return the entire order, or if preferred, can return any of the products that were part of the total order, all without any penalty and without the need to state reasons.

The user will be responsible for the costs of returning the order (such as shipping costs through courier companies), whether returning the entire order or deciding to return only some of the products in the order. The User can choose the means and method of returning these products.

Once Charcutería Seco has confirmed the perfect condition of the returned products and that the order is in good condition, it will proceed to refund the amount paid by the user for the item(s) using the same payment method used for the purchase. The User will be notified via email of the payment for the return of their product.

If it is a return due to 'non-acceptance of delivery' because the User was not at their address for each delivery attempt or did not come to an agreement with the courier, the initial shipping costs, as well as the handling and return costs, will be the responsibility of the User.

In the event that a product is returned from an order with free shipping, and after returning it, the initial order no longer meets the requirements for free shipping, the amount not charged for shipping will be deducted from the refund.

Due to consumer and hygiene regulations, returns of any product that has been opened or tampered with in its original packaging will not be accepted.

Returns will not be accepted for products ordered specifically from the factory for a customer.

* Money refunds will only be processed for online orders.

 - Withdrawal:

When making a purchase through Charcutería Seco, you have the right to withdraw from the sales contract. The withdrawal period is 14 calendar days from the receipt of the order. The withdrawal period expires 14 calendar days from the day you or a third party indicated by you, other than the carrier, acquired physical possession of the goods.

To exercise the right of withdrawal, you must notify us of your decision through an unequivocal statement. You can use the return form that was sent to you with your online order, fill in the requested information, and send it along with the return.

To meet the withdrawal deadline, it is sufficient that the communication regarding your exercise of this right is sent before the corresponding deadline expires.

In the event of your withdrawal, we will refund the amount of the received item(s) at our facilities, after checking their condition, excluding shipping costs, no later than 14 calendar days from the date we are informed of your decision to withdraw from this contract. We will process the refund using the same payment method that was used for the order, except when the order was paid by bank transfer or cash on delivery. In these cases, the refund will be made via bank transfer. We may withhold the refund until we have received the goods or until you have provided proof of the return, depending on which condition is met first.

You must return the goods to us without undue delay and, in any case, no later than 7 calendar days from the date on which you communicate your decision to withdraw from the contract. The deadline will be considered met if you return the goods before this period has expired. You shall bear the direct cost of returning the goods. You are only responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

 - Exclusions:

Notwithstanding the provisions of the previous section, Charcutería Seco may deny the return of certain products in accordance with Article 103 of the General Law for the Defense of Consumers and Users, which states that the right of withdrawal shall not apply to 'the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.'

Thus, the right of withdrawal shall not apply to contracts related to:

a) The supply of goods made to the consumer's specifications or clearly personalized.

b) The supply of goods that are liable to deteriorate or expire rapidly.

Except for production defects, provided that the products have not been tampered with.

Returns will not be valid if the product has been opened or tampered with in its original packaging. However, in this case, the customer may request that the product be resent, bearing the shipping costs.

5. User Accounts

The Website offers Users the option to create an account through an online form that must be filled out with the required information.

In this regard, the User will be responsible for providing accurate, current, and complete data about their personal identity, as requested in the registration section of the Charcutería Seco Website, and to keep such data updated and make immediate updates to ensure their accuracy, currency, and completeness."

Users shall bear full responsibility for the use of their account. Consequently, Users are responsible for the proper custody and confidentiality of their username and/or passwords that allow them access to their account. They undertake not to transfer their use to third parties, whether temporarily or permanently, or to allow access to third parties.

In light of the above, Users shall immediately notify Charcutería Seco via email at charcuteriasecoareacentral@gmail.com of any misuse of their username and/or password, due to circumstances such as theft, loss, or unauthorized access, so that Charcutería Seco can proceed with its cancellation, blocking, and/or disabling as soon as it becomes aware of the improper use of the User Account. Until such incidents are reported, Charcutería Seco shall be exempt from any liability that may arise from the misuse of usernames or passwords by unauthorized third parties.

6. User Conduct on the Website

Users undertake to make lawful, diligent, honest, and proper use of all the information or content they have access to through the Website, all under the principles of good faith and in compliance with current law and these Terms and Conditions of Sale. In particular, but not limited to, Users shall not:

  • Register or provide information that is not true, accurate, complete, and/or up-to-date, or access the Website using another User's name, identifying information, or password, or impersonate any person or identity.
  • Use the Website for fraudulent purposes, or for criminal activities or any kind of unlawful activities.
  • Introduce or disseminate computer viruses that may cause unauthorized alterations to the contents or systems that make up the Website.
  • Create a Profile or use the Website to send, use, or reuse illegal, offensive, pornographic, abusive, indecent, defamatory, obscene, or threatening material of any kind, or material that constitutes a violation of copyright, trademarks, confidentiality, privacy, or any other right, or is otherwise injurious or objectionable to third parties.
  • Download, send, or otherwise distribute content or applications that may violate any current legislation or infringe upon the rights of any party.

Charcutería Seco reserves the right to deny any attempt to access the Website, cancel accounts, delete or modify content, or terminate the provision of services in cases of misuse of the Website.

7. Orders and Sales Conditions

To make a purchase, the User must be at least 14 years of age, or, if not, they must have obtained prior authorization from their parents, guardians, or legal representatives, who will be responsible for all actions performed through the Website by minors under their care.

Charcutería Seco accepts orders for the entire Iberian Peninsula and the Balearic Islands.

If the User decides to cancel and/or modify the order after it has been placed, the cancellation and/or modification of the order will incur a cost that must be borne by the User. Specifically, the cost will be communicated by Charcutería Seco at the time when the User decides to make this modification.

8. Price and Discount Codes

Once the user has completed the form, they should proceed with the payment of the order using the payment methods specified on the Website.

After the payment is made, the User will receive an order confirmation email, which will include a summary of the items purchased, the chosen shipping method, and the destination address.

The valid prices and delivery costs will be those indicated by Charcutería Seco at the time the User places the order. Service prices are expressed in Euros (€), including taxes and management and shipping costs, the amount of which will be indicated at the time of the final confirmation of each order.

Therefore, when proceeding with the payment of the order, the total price will be detailed, including the corresponding shipping costs.

Charcutería Seco reserves the right to modify the sale prices listed on the Website at any time.

Charcutería Seco may offer discount codes to its Users. Such discounts can only be applied according to the instructions provided by Charcutería Seco regarding each code.

The prices on the online store may vary compared to those in the physical store and depending on the delivery and billing address.

All our prices include applicable taxes.

9. Payment Methods

Charcutería Seco offers the following payment method:

- Credit Card: With this payment method, you will be directed to a virtual POS or SECURE payment platform, where you will need to enter the required information as requested by our bank to complete the purchase. This is the most cost-effective way to place an order because it is exempt from any type of commission. To make the payment, your credit card must be enabled for online purchases. If it's not enabled, you can activate it through your bank. Once we receive the payment, we will proceed to ship the product.

Charcutería Seco will not be responsible for the non-delivery or delays in the delivery of a package if the customer does not provide their complete details, as indicated in our order email, which include:

1. Full name with both surnames.

2. Correct and complete address with postal code.

3. Contact phone number in case there is an issue with the delivery.

When you place an order in our store, you agree to the terms and conditions described in this section and the privacy policy, releasing Charcutería Seco from any responsibility.

10. Product and Service Information

The data included on the Website in the product descriptions are based on information provided by Charcutería Seco's suppliers and are for informational purposes only. Information about services provided on this website is intended for public knowledge and will always be subject to the terms and conditions explicitly detailed at any given time, which can be accessed from this website and will be subject to various applicable legal provisions.

Charcutería Seco disclaims any responsibility for the appearance of errors in such information, although it commits to take all possible measures to correct such errors or omissions as soon as they are reported.

Charcutería Seco informs Users that any offers made for the products or services listed on the Website, if applicable, are temporary and are only valid for the online store. After the specified temporary period, it will no longer be possible to make the purchase, and the offers will be removed from the Website.

11. Warranties

The customer enjoys a full warranty in case the product is defective. All costs associated with the return due to poor condition, breakage during shipping, or any other incident will be covered by Charcutería Seco. The customer must contact Charcutería Seco to report non-conformity within a maximum of 7 days. Charcutería Seco is responsible for non-conformities that manifest within two years from the delivery.

In the case of a defective product, Charcutería Seco must proceed, as appropriate, to replacement, price reduction, or contract resolution, all of which will be free of charge for the consumer and user. The consumer and user must inform Charcutería Seco of the non-conformity within 7 days from becoming aware of them. If this deadline is exceeded, any damages incurred by Charcutería Seco due to the delay in reporting will be assumed by the User. These warranties will be applied considering the nature of the goods sold on the website.

To process the return, the User must contact Charcutería Seco within the 7-day period granted through this link or by writing to charcuteriasecoareacentral@gmail.com, indicating the product or products subject to return, attaching a photograph, and providing a detailed list of the defects observed in them.

Once Charcutería Seco has received the User's communication, it will inform the User whether the return of the product is appropriate or not. In the event that the return is approved, Charcutería Seco will inform the User of the method for the collection or shipping of the defective product to its offices/warehouses.

Once the product is received and the defects are confirmed, Charcutería Seco will give the User the option to replace the product with another of identical characteristics, unless this option is objectively impossible or disproportionate for Charcutería Seco.

If, for reasons of lack of stock, it is not possible to send another product with identical characteristics, the contract will be terminated, and the amount paid will be refunded.

The replacement or contract termination will not involve additional costs for the User.

The refund period for the amounts paid will depend on the payment method used by the User when purchasing the product.

In any case, Charcutería Seco will refund the amounts paid as soon as possible and, in any case, within 14 calendar days from the date the User informed of their decision to withdraw from the contract, and once the returned items have been received and verified.

12. Access and Use

Both access to this website and the use of the information and content included therein will be the exclusive responsibility of the person performing them. Access conditions to this website will be subject to current law and the principles of good faith and lawful use by the user, with any type of action that may be detrimental to secogourmet.com strictly prohibited. The use of this website for illegal or unauthorized purposes is strictly prohibited. Any form of exploitation, including all kinds of reproduction, distribution, transfer to third parties, public communication, and transformation, by any means and medium, of the works, creations, and distinctive signs mentioned above, without the prior and express authorization of their respective owners, is prohibited.   • Breakdowns and incidents caused by the lack of due diligence on the part of the User or by the improper use of the Website.
  • The lack of availability, maintenance, and effective operation of the Website, excluding, to the fullest extent permitted by current legislation, any liability for damages of any kind that may be due to the lack of availability or continuity of the operation of the Website.
  • The unlawful, negligent, fraudulent, contrary to the terms of these Terms and Conditions of Sale, or bad faith use of the Website by Users.
  • Force majeure cases, understood as the failure, suspension, or interruption of services or use of the Website as a result of the blocking of the Internet network, actions or omissions of third parties, or any other causes or circumstances beyond the control of the PROVIDER that prevent the normal use of the Website.
  • The cancellation or suspension of Website services for reasons not attributable to the PROVIDER.
  • Delays in the delivery of orders for reasons beyond Charcutería Seco´s control.
  • Users wishing to make changes and cancellations of orders outside the established deadlines in these conditions.
  • Delays that may occur in the shipment of orders due to reasons beyond Charcutería Seco (customs, weather conditions, etc.) and/or due to circumstances attributable to third parties.
